Generally how many days it takes to get the actual RFE in hand.
I saw status update on May 20th and yet to get the copy in hand.
Me or my lawyer have not received it yet.
What are the next steps if we don't get it soon.

REFILING
Can the employer refile a labor certification application filed under the previous permanent labor certification regulations under the new streamlined system and retain the filing date of the original application?
Yes, if a job order has not been placed pursuant to the regulations in effect prior to March 28, 2005, an employer may refile by withdrawing the original application and submitting, within 210 days of withdrawing, an application for an identical job opportunity which complies with all of the filing and recruiting requirements of the new PERM regulation.
NOTE: Indicating on the Application for Permanent Employment Certification, ETA Form 9089, the desire to use the filing date from a previously submitted application, i.e., marking "yes" to question A-1, is deemed to be a withdrawal of the original application.

What EndlessWait meant was, more the number of employees in a small company, the chances of RFE with ability to pay will be higher...
Overall true, just one clarification... More the number of employees that have applied for a GC, chances of RFE are higher.
Am I correct?

3 deportations at POE (EWR) till date this yr .
only offence was they all working in the midwest (Kansas) and their company was based in nj .. admins can we start tracking deportations and make this as a sticky

The original poster "getrdone" wrongly pressed panic button. There is no change from 2004 thru till now. I went to mexico several times for stamping. I have seen several people who got stamping for H1-H1 & F1-H1 (Safe), H4-H1 & B1-H1 (Lucky guys)...In anycase, taking Mexican Visa (though absolutely not mandatory) is advised
The change of status cases (F1 -> H1, H4 -> H1 etc) are not allowed anymore at Mexico. I think it went into effect last month.

if u go to the doc, they will perform the the tests that are ok to perform..
Check with doc if they will accept the test results (PAP , HIV , etc) from your obgyns office. These tests are already done during initial stages of pregnancy.
Finally the doc will add a note to the medical report that some tests/shots are omited due to pregnancy.

You do not loose your priority date even if the old employer revokes the 140.
As long as there aren't be any provable fraud intentions involved, in the whole GC process with the old employer, the priority date remains with you.

I just came back from bombay. I did not have an AP. I went to the consulate for stamping. If you are maintaining valid h1b status and have a stamp, there is no issue at all. Just carry your I-485 receipt with you and make sure you mention it at POE.

I gave my 3rd FP for pending 485 last week. Haven't seen any LUD change since. My NC was cleared last year as per USCIS. My question is after every FP, does FBI initiate a new name check? is this a vicious circle ?

I did a lot of research and found very little information on an established process of "firing" one's attorney and moving to self-represent the I485 application. Most resources talk about submitting a new G-28 form from a new attorney. What if I don't want an attorney to represent me anymore? is there a form for that?

Myy EAD is expiring and Renewal is taking more than 1 year as per new processing times.
Can I switch back to H1-B. I am in EAD and I dont have any H1-B status now. I have used 5 1/2 years of h1B previously. Six years is not utilized
What are pros and cons..

As per my understanding , as long as you file for renew your EAD before the expiry you are in status , so why do you want to go back to H1??

I called once after my PD became current this month, that was last Wednesday (9th). The IO that I spoke to would not give me any information. All she said was "You will hear from us within next 60 days". So I guess it all depends on the IO that you speak to. As for LUDs, I did not get any since my FP.
As for Cross Chargeabilty, I saw a post on a successfull case only yesterday on IV forums. So it actually works. Hope you hear some good news soon.
BTW how did you request CIS to use your spouce's country of birth? Did you send then a letter requesting it? How about requesting an INFOPASS to get their attention?
